Customs Classification 2025 | Adjusted EU subheadings (8-digit): New shark species and fresh tomatoes with a certain diameter

I hope you have a happy and successful New Year!
New CN subheadings were introduced on 1 January 2025.
These include, for example, fresh tomatoes of a certain size and new types of shark.
I'd like to give you a gentle overview of the adjusted subheadings of the Combined Nomenclature of the EU Customs Tariff.
The good news
There are no significant changes for most companies. Most CN subheadings remain unchanged.
To make it easier for you to skim through this text, I dedicated a separate chapter to each change and placed the relevant HS heading at the beginning of each subheading.

0302 to 0304: New shark species of fresh, non-living fish (chilled & frozen & fillets)
The "Shortfin Mako shark" (Isurus Oxyrinchus) is now included in a new subheading, namely
0302 81 50 (chilled)
0303 81 50 (frozen)
0304 88 22 (frozen fillets)
If companies trade in other sharks, the new collective subheadings for the other sharks should be used:
0302 81 70 (chilled)
0303 81 80 (frozen)
0304 88 29 (frozen fillets)
0303 & 0305: Shark fins are identified separately by species
Frozen shark fins of the following species must now be classified separately:

0702: Diameter of fresh and chilled (cherry) tomatoes now decisive
Whole tomatoes with a largest diameter of less than 47 mm must now be classified separately.
→ This should apply to some cherry tomatoes.
New subheading: 0702 00 10
All other "remaining" tomatoes will have new subheadings.
2710: Gas oils without biodiesel, with max. 0.001% sulphur and at least 80% bio-based carbon according to standard EN 16575
→ only applies to gas oils
“for other purposes” than for undergoing a specific process (see Additional Note 5 to Chapter 27) or for chemical transformation
without biodiesel (Subheading Note 5 to Chapter 27)
→ Gas oils are defined by Additional Notes 2d) and 2e) to Chapter 27 as follows:
"gas oils" mean heavy oils above of which 85 % or more by volume (including losses) distils at 350 °C by the ISO 3405 method (equivalent to the ASTM D 86 method)
"heavy oils" mean oils and preparations of which less than 65 % by volume (including losses) distils at 250 °C by the ISO 3405 method (equivalent to the ASTM D 86 method) or of which the distillation percentage at 250 °C cannot be determined by that method;
New subheadings:
→ 2710 19 42 (gas oils concerned)
→ 2710 19 44 (all others)
2710: Waste oils containing polychlorinated biphenyls (PCBs) at a concentration level of 50 mg/kg or more
→ Oil wastes are further defined in Note 3 to Chapter 27
New subheading:
2710 91 10 (oil waste concerned)
2710 91 90 (other oil wastes containing PCB, PCT, PBB)
2903: Pure hexabromocyclododecane (HBCD)
New subheading for pure hexabromocyclododecanes (HBCD)
Companies that have other pure halogenated derivatives of cyclanic, cyclenic or cycloterpenic hydrocarbons in their portfolio should take a closer look because some of these derivatives are now classified under a different collective subheading:

2929: Pure N,N-dimethylphosphoramidic dichloride

Companies that have other compounds with other nitrogen function in their portfolio should take a closer look because some of these compounds are now classified under a different collective subheading:

2930: Pure phorates (ISO)

3102: Urea containing more than 45% nitrogen in aqueous solution, containing 31.8% to 55% of urea
New subheading for affected products containing at least 31.8% to 33.2% of urea

Companies that have other non-compressed wood waste in their portfolio should take a closer look, as some of this waste is now classified under a different collective subheading:
→ 4401 49 90
4411: Laminate floor coverings made of HDF fiberboard with a thickness of more than 5 mm
Laminate floor coverings of HDF fiberboard are now classified under two separate subheadings:
→ 4411 13 91 (of a thickness exceeding 5 mm but not exceeding 9 mm)
→ 4411 14 91 (with a thickness of more than 9 mm)
The HS Explanatory Notes to heading 4411 describe HDF fiberboards as follows:
Medium density fiberboard with a density greater than 0.8 g/cm3 is sometimes commercially referred to as high density fiberboard (HDF).
Companies that have other HDF fiberboards in their portfolio should take a closer look because some of these fiberboards are now classified under a different generic subheading:
→ 4411 13 93 (with a thickness of more than 5 mm up to 9 mm)
→ 4411 14 93 (with a thickness of more than 9 mm)
8503: Steel laminations and stator and rotor cores of electric motors (8501) and generating sets (8502)
Steel laminations and stator and rotor cores of electric motors of heading 8501 and generating sets of heading 8502 are now classified in a separate subheading:
Companies that have other exclusively recognizable parts of electric motors or generating sets in their portfolio should take a closer look because some of these parts are now classified in a different collective subheading:

8521: Magnetic tape recorders
Good news! Magnetic tape recorders of all kinds are now grouped under a single CN subheading:
8527: RDS-capable CD car radios
Good news! RDS-capable CD car radios of all types are now grouped under a single CN subheading:
8528: TV signal receivers without built-in screen (e.g. set-top boxes, USB sticks for DVB-T reception)
Good news! TV signal receivers without a built-in screen of all kinds are now only grouped together in a single CN subheading:
8529: Exclusively recognizable parts for radio receivers (“radios”), monitors and TV signal receivers are grouped together
Above-mentioned products are grouped in one CN subheading:
→ 8529 90 93 (products mentioned above, but not PCBAs, custom-fit LED modules for TV sets or aerials and aerial reflectors of all kinds)
Exclusively recognizable parts (but not PCBAs or aerials and aerial reflectors of all kinds) of the following headings are classified under subheading 8529 90 96:
heading 8524: Flat panel display modules
heading 8525: Transmission apparatus for radio-broadcasting or television, TV cameras, digital cameras and video cameras
heading 8526: Radar apparatus, radio navigational aid apparatus and radio remote control apparatus
