We conclude this year's blog series with a seasonal topic: the customs classification of Christmas items as per heading 9505.
In this article, we will show which products are explicitly considered as Christmas items – and which do not fall under this category despite their festive design. The basis is the customs tariff distinction between genuine Christmas items and general winter decorations.
Christmas items: Items widely regarded as traditional Christmas or Advent season objects and exclusively manufactured and designed for this purpose include:
Items associated with the birth of Christ, such as nativity figures, nativity animals, the Star of Bethlehem, the Three Wise Men, and nativity scenes.
Items considered as suitable for the Christmas or Advent season due to old national traditions, such as:
artificial Christmas trees,
Christmas stockings,
Christmas logs,
Christmas crackers,
Santa Clauses (even with sleds),
Christmas angels.
The customs tariff does not consider as Christmas items the so-called winter items, which are suitable for broader use as decorative items during this season, as their objective characteristics indicate that they are not exclusively for the Christmas or Advent season, but primarily for decoration during the winter season . This includes items such as
icicles,
snowflakes,
stars,
reindeers,
robins,
snowmen and other winter motifs, regardless of whether their colors or design, etc., suggest a connection to Christmas.
Decoration items for Christmas trees: These are items intended for hanging on a Christmas tree, typically made of lightweight, non-durable material, to decorate a Christmas tree (e.g., baubles, tree ornaments).
